DMCA Copyright Policy
Last Updated: December 9, 2024
Our Position
BookMorph is a software tool, not a content publisher or distributor. We provide AI-powered translation technology. Users upload their own files, and we process them on-demand. We do not store, host, or distribute copyrighted books.
However, we respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA).
User Responsibility
By using BookMorph, users represent and warrant that:
- They own the book they are translating, OR
- They have explicit permission from the copyright holder to create a derivative work (translation)
- The book is in the public domain
Users are solely responsible for ensuring they have the legal right to translate any book uploaded to our service.
DMCA Takedown Process
If you believe that content processed through BookMorph infringes your copyright, please send a written notice to our designated DMCA agent:
Email: support@bookmorph.io
Your Notice Must Include:
-
Identification of copyrighted work:
Description of the copyrighted work you claim has been infringed (e.g., book title, author, ISBN). -
Identification of infringing material:
Information sufficient to locate the material (e.g., user account, timestamp, transaction ID if known). -
Your contact information:
Name, address, telephone number, and email address. -
Good faith statement:
A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law. -
Accuracy statement:
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf. -
Signature:
Physical or electronic signature.
Our Response
Upon receiving a valid DMCA notice, we will:
- Investigate the claim within 24 hours
- Remove access to the allegedly infringing material if the claim is valid
- Notify the user who uploaded the content
- Suspend the user's account if necessary (for repeat offenders)
Important: Because BookMorph does not store translated books permanently, there may be no material to remove. However, we will take appropriate action against the user account.
Counter-Notification
If you believe your content was wrongly removed, you may file a counter-notification to our DMCA agent including:
- Your contact information
- Identification of the removed material
- A statement under penalty of perjury that the material was removed by mistake or misidentification
- Consent to jurisdiction of federal court
- Your physical or electronic signature
We will forward your counter-notification to the original complainant. If they do not file a lawsuit within 10-14 business days, we may restore access.
Repeat Infringer Policy
We will terminate accounts of users who repeatedly infringe copyrights. A "repeat infringer" is defined as a user who has received two or more valid DMCA takedown notices.
Limitations
BookMorph does NOT:
- Host or store user-uploaded books long-term
- Distribute translated books to third parties
- Create a public library of translations
- Sell pre-translated books
BookMorph DOES:
- Provide a tool for users to translate their own books
- Process files on-demand and delete them after delivery
